There is a sunset clause on the creation of RECs for all SGU units installed after 6th October 2007. The RECs for all systems must be created within 12 months of the date of installation. Creation must be within the 12 month period regardless of the deeming period (1, 5 or 15 year). The Sunset Clause means that any photovoltaic systems that have been installed for more than 12 months will not be eligible to claim any RECs. Installations outside of the 12 month period are not able to claim under 1 or 5 year deeming so will not be eligible for any RECs. As determined by the Regulator the definition of an eligible premises has been updated. MORE THAN ONE PREMISES LOCATED AT A SINGLE ADDRESS Where more than one separate premises (excluding outbuildings) is located at a single address, all of those premises are separate eligible premises. Examples might include a: - Dairy on a farm that is separate to the residential house on the same farm - both premises are eligible premises - Owner/Managers house that is separate to the rest of a caravan park but at the same address - the house is a separate eligible premises to the caravan park - Green Keepers house that is separate to the rest of the golf course at the same address - the house and the business premises are separate eligible premises To be another 'eligible premises' at a single address, the premises must be clearly separate from the other eligible premises located at the address. A building is not an eligible premises if it is an outbuilding associated with a house, for example: - a garage, studio or other small building situated in close proximity to a house which itself is an eligible premises (where a small business may be carried out) is as an outbuilding and NOT another eligible premises - a larger business premises that is not a subordinate to a house which itself is an eligible premises, and which more commonly is located further from the house than is usual for a garage or studio, is not an outbuilding and therefore a separate eligible premises. The negotiations in Copenhagen are stalling, but unknown to most they can legitimately continue into tomorrow Saturday. The final days of the COP15 have been marred by the resignation of Connie Hedegaard with her replacement being the Prime Minister of Denmark, Lars Locke Rasmussen. I think his delivery of a possible "new text" for the Long-term Co-operative Action was premature and led to a further mistrust in the process. This diverted the debate back to what was appropriate practice rather than the outcomes that are need to go forward. Around 130 heads of state including Prime Minister Kevin Rudd and US President Obama will arrive at the climate change negotiations in Copenhagen around Wednesday this week. It is being hailed as the single biggest international meeting in history, with around 34,000 delegates, most of whom will have highly restricted access to the conference this week. Because of so much political fire power, it is guaranteed the climate negotiations will be hailed a “success” by the weekend. The question is what they define as success. This remarkable mass gathering of world leaders has cut short the time for negotiations over draft texts for international agreements, binding or otherwise. There is simply not time to finish before leaders arrive and take over the process. What they do with this opportunity is uncertain. We know Kevin Rudd has been tracking the process closely, and has been working the phones with other world leaders. We know Penny Wong has been working hard since she arrived last week to try and make progress on some form of agreement. We know the lead Australian negotiators are more upbeat than many others on the ability of leaders to transform this momentum into outcomes. But no one knows what we will end up with by Friday night.

RECs Going Forward---Over Supply---SWH 12 Month Sunset Clause RECs are a Environmental credit, created to meet the liability of the energy retailers and the large wholesale users of energy under the expanded Renewable Energy Target. As you can see, the surplus is very significant and has been created by the growth of the Solar Water Heating Market. Nominally 5.5M RECs have been created by SWH this year, and it is going to continue we think for some time. If there are no changes to how the scheme operates the price of RECs will remain flat for probably the next year or two. Some clients have chosen to hold onto their RECs hoping that the price of RECs will recover, but unfortunately have forgotten there is a 12 month sunset clause on their creation and have sent them into Greenbank and unfortunately we cannot create them at all.
